These Terms of Service (the "Terms") set out the conditions for using the iOS app "Otakara Sanpo" (the "App") provided by AppsTake ("we"). By using the App, you are deemed to have agreed to these Terms.

1. Application of These Terms

These Terms apply to all relations between us and users regarding the use of the App. If you do not agree to these Terms, please refrain from using the App.

2. The Service

The App helps you enjoy and sustain a walking habit: decode a daily "treasure map," walk to the destination, and collect the treasures you find in a gallery. The App is not a location-based game; it is a tool that rewards walking. It does not encourage or direct visits to any specific place. A destination is merely one example generated automatically based on your current location.

3. Important Safety Notice (Disclaimer)

The App involves walking. Your safety comes first. You use the App at your own risk and must do so with due care for safety.

Follow traffic rules and always check signals and crosswalks.
Do not look at the screen while walking; stop before operating the App.
Do not enter dangerous places, private property, or deserted areas at night.
Watch out for people, bicycles, and vehicles, and keep a safe distance.
Children must use the App together with a guardian.

Destinations, routes, and distances shown by the App are approximate and are not guaranteed to be safe, accurate, or passable. We assume no liability for any accident, damage, or trouble arising from or related to use of the App.

4. In-App Purchases & Subscriptions

The App includes a paid subscription (Premium) offering additional features. Purchases are made through Apple's App Store.
Subscriptions auto-renew. Unless canceled at least 24 hours before the end of the period, they renew automatically at the same price and term.
You can cancel anytime via iOS "Settings → Apple ID → Subscriptions." Where a free trial is offered, any unused portion may be forfeited when purchasing a plan that includes a trial.
Pricing and plans follow what is displayed in the App and on the App Store.

5. Prohibited Conduct

When using the App, you must not:

Violate laws or public order and morals.
Misuse the App, reverse-engineer, tamper with, or attempt unauthorized access.
Infringe the rights of us or any third party.
Engage in any other conduct we deem inappropriate.

6. Intellectual Property

Intellectual property rights in the App and its contents (illustrations, text, logos, software, etc.) belong to us or the rightful owners. You may not reproduce, redistribute, or modify them beyond the scope of private use.

7. Disclaimer of Warranties

The App is provided "as is." We do not warrant that the App fits a particular purpose, operates without errors or interruptions, or that data will not be lost. Some features may be unavailable due to device issues, OS updates, network conditions, and the like.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any damages (including direct, indirect, incidental, or consequential damages) arising from the use of or inability to use the App.

9. Changes to These Terms

We may revise these Terms as needed. The revised Terms take effect when posted on this page.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
